Your agreement with Project Fluency
By creating an account or using Project Fluency™ ("the Service"), operated by Project Fluency, Inc. (a Delaware corporation), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform. We may update these terms from time to time — continued use after changes constitutes acceptance. We will notify you of significant changes via email.
Age Requirement: You must be at least 13 years old. Users aged 13–17 must have parental consent.
Project Fluency is operated by Project Fluency, Inc. Our platform provides AI-powered language learning through conversational practice with 60+ AI characters across 5 languages (Spanish, Italian, French, Portuguese, English), plus drilling exercises, adaptive questions, and spaced repetition via Fluent Mode. Our AI characters are educational tools, NOT licensed teachers or certified experts. They may occasionally provide incorrect information. Project Fluency is a language learning tool, not a certified educational institution. We do not guarantee specific learning outcomes, fluency levels, or professional certifications.
You are responsible for maintaining the security of your account credentials. Do not share your account — accounts are licensed to individual users.
Project Fluency offers free access plus monthly and annual subscriptions.
Prices listed in USD. Subscription fees are billed monthly or annually through Stripe (web), Apple In-App Purchase (iOS), or Google Play Billing (Android), as described in Section 5. Annual subscriptions are exclusively available via web purchase through Stripe. All prices are subject to change with at least 30 days' advance notice. By subscribing, you authorize recurring charges to your selected payment method until you cancel.
Promotional & Complimentary Access: Project Fluency may, at its discretion, grant promotional, beta, or complimentary access to the platform without charge. Such access does not establish a paid subscription, may be modified or revoked at any time, and is governed by these Terms.
Project Fluency uses different payment platforms depending on where and how you subscribe. Annual plans are exclusively available via web purchase.
Refunds: Refunds for purchases made through Apple In-App Purchase are subject to Apple's refund policies and may be requested through Apple Support. Refunds for purchases made through Google Play Billing are subject to Google's refund policies and may be requested through Google Play. Web purchases through Stripe follow our Refund Policy below.
Users who enrolled during the beta period may receive enhanced minute allocations or other grandfathered benefits. These allocations are permanent for qualifying accounts and will not be reduced as long as the subscription remains active. All other tier features and pricing apply as normal. Project Fluency is a continuously evolving platform — features may change, be added, or removed. Service interruptions may occasionally occur.
Conversation minutes are the currency of the platform. Minutes are allocated based on your plan and deducted in real time during conversations. Assessment conversations do not consume minutes.
Subscription minutes reset each billing cycle and do not roll over.

The system always draws from your monthly allocation first, preserving any permanent minutes.
PTO credits are earned automatically through regular conversation practice at rates determined by your plan tier (Free 5%, Tourist 10%, Local 15%). PTO never expires. Credits can be redeemed in the PTO Store for learning rewards including Replay Analysis, Study Guides, Gift Codes, and Discounts. Monthly earning is capped at 180 PTO; maximum balance is capped at 500 PTO. PTO has no cash value and cannot be transferred between accounts.
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled. You authorize us to charge your payment method on each renewal date until you cancel.
You agree to use Project Fluency for personal language learning purposes. You may NOT:
Platform Content: All content, characters, character backstories, the Don Joaquín Universe, course materials, software, and branding are the property of Project Fluency, Inc. and protected by intellectual property laws.
Your Conversations: Your conversation transcripts and personal learning data belong to you. We retain a license to use anonymized, aggregated data to improve our platform and services.
We strive for continuous availability but do not guarantee uninterrupted service. The Service is provided "AS IS" without warranties. We are not liable for downtime caused by third-party services (including but not limited to ElevenLabs, Anthropic, Stripe, Apple, Google, and Supabase), internet outages, or events beyond our control. If extended downtime materially affects your subscription, we may extend your billing period at our discretion.
Our liability is limited to the amount you paid for services in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.
We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or attempt to exploit the platform. You may terminate your account at any time through the account deletion option in your settings. Upon termination, your right to access the platform ceases, though we may retain certain data as required by law or for legitimate business purposes.
Project Fluency for Teachers is a separate SaaS product designed for independent language teachers, currently in early access. These Terms of Service govern use of the consumer learning platform only. Use of Project Fluency for Teachers is governed by separate Terms of Service, which will be presented at the time of teacher onboarding.
Promotional offers — including founding member pricing — are honored according to those separate Terms for users who enroll during applicable promotional periods. For more information, visit projectfluency.com/teachers.
Governing Law: State of Delaware, United States.
Dispute Resolution: Any disputes shall be resolved through binding arbitration administered in accordance with applicable rules, except where prohibited by law. You retain your right to pursue claims in small claims court.

During conversations, your voice is transmitted to one or more third-party speech processing providers for real-time speech recognition and AI character voice generation. Voice audio is processed transiently and is not permanently stored after the conversation ends.
By using Project Fluency, you acknowledge that your voice audio and conversation data are processed by third-party artificial intelligence, voice synthesis, and speech recognition services to provide real-time voice conversations, language corrections, and personalized learning experiences. The specific providers used may vary; see Section 4 for the current list of service provider categories.
Transcripts: Conversation transcripts are stored to enable character memory and adaptive learning. Transcripts are retained as long as your account is active, unless you request deletion. We do not use your voice data for AI model training.
To deliver AI-powered language learning experiences, your data may be processed by one or more third-party service providers within the following categories. Depending on service availability, capacity, and regional requirements, the specific providers used may change over time:
All service providers are bound by data processing agreements restricting use of your data solely to delivering application functionality on our behalf. We share only the minimum data necessary for each service to function. Your personal data is never sold, rented, licensed, or otherwise disclosed to third parties for their own commercial purposes.
We use industry-standard security measures including encrypted connections (HTTPS/TLS), row-level security on database tables, signed URLs with expiration for sensitive content, and secure API key management. Payment information is handled entirely by Stripe, Apple, and Google — we never store credit card numbers on our servers. No security method is 100% secure, but we are committed to protecting your data.
We retain your account data, conversation transcripts, and learning history for as long as your account is active. Cancelled accounts retain data for 12 months to facilitate potential return.
Account Deletion: Upon deletion request (via account settings), personal data is permanently removed within 30 days. This is irreversible. Anonymized, aggregated analytics data may be retained indefinitely.

Project Fluency is intended for users aged 13 and older. We do not knowingly collect personal information from children under 13. If we learn that we have collected data from a child under 13, we will delete it promptly. Parents who believe their child has provided personal information should contact us at hello@projectfluency.com.
GDPR (EU): Right to erasure, portability, and complaints to data authorities. Data may transfer to US with safeguards.
CCPA (California): Know, delete, opt-out rights. We don't sell data.
We may update this Privacy Policy to reflect changes in our practices or legal requirements. We will notify active users of significant changes via email at least 14 days before they take effect. The effective date at the top indicates the most recent revision.

Our commitment to fair billing
We charge what it costs to deliver real AI conversations with characters who remember you — and we want you to feel confident that your money is well spent. Subscriptions have a refund window. If something isn't right, contact us and we'll make it right.
Note on payment platform: Refunds for purchases made through the Apple App Store or Google Play are subject to those platforms' refund policies and must be requested through Apple or Google directly. The terms below apply to web purchases made through Stripe.

If you believe you were charged incorrectly — duplicate charges, wrong amount, or charges after cancellation — contact us immediately at hello@projectfluency.com. Include your account email, the charge amount, and the date.
We will investigate within 24–72 hours and issue a full refund for any confirmed billing error, regardless of the 7-day refund window. For charges made through the Apple App Store, you may also contact Apple Support directly. For charges made through Google Play, you may also contact Google Play support directly.
