Terms of Service

Your agreement with Project Fluency

Effective: March 15, 2026
1. Acceptance of Terms

By creating an account or using Project Fluency™ ("the Service"), operated by Project Fluency Inc., you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform. We may update these terms from time to time — continued use after changes constitutes acceptance. We will notify you of significant changes via email.

Age Requirement: You must be at least 13 years old. Users aged 13–17 must have parental consent.

2. About Project Fluency

Project Fluency is operated by Project Fluency Inc. Our platform provides AI-powered language learning through conversational practice with 60+ AI characters across 5 languages (Spanish, Italian, French, Portuguese, English), plus drilling exercises, adaptive questions, and spaced repetition via Fluent Mode. AI Disclosure

Our AI characters are educational tools, NOT licensed teachers or certified experts. They may occasionally provide incorrect information. Project Fluency is a language learning tool, not a certified educational institution. We do not guarantee specific learning outcomes, fluency levels, or professional certifications.

3. Account Responsibilities
Your Responsibility

You are responsible for maintaining the security of your account credentials. Do not share your account — accounts are licensed to individual users.

  • Provide accurate information during registration
  • Maintain password security
  • You are responsible for all activity under your account
  • Notify us immediately at hello@projectfluency.com if you suspect unauthorized access
4. Subscription Plans & Billing

Project Fluency offers free access, one-time purchases (Coffee Chats), monthly subscriptions (Tourist and Local), and a commitment product (One Way Ticket).

  • Free: 45 conversation minutes (one-time, no credit card required)
  • Coffee Chat: $3.99 — 30 minutes, one-time purchase (max 3 per account, not available to subscribers)
  • Tourist: $12.99/month — 120 minutes per month
  • Local: $29.99/month — 300 minutes per month
  • One Way Ticket: $178.99 — 1,500 minutes over 90 days (US only, non-refundable)

Prices listed in USD. MXN pricing available where applicable. Subscription fees billed monthly through Stripe (web) or Apple In-App Purchase (iOS). All prices subject to change with 30 days' advance notice. You authorize recurring charges until you cancel.

5. Beta Program

Users enrolled in the Tourist Beta program receive 180 minutes per month instead of the standard 120 minutes. This allocation is permanent for beta enrollees and will not be reduced. All other Tourist tier features and pricing apply as normal. The Service is provided "AS IS" during beta — features may change, be added, or removed. Service interruptions may occur.

6. Minute System

Conversation minutes are the currency of the platform. Minutes are allocated based on your plan and deducted in real time during conversations. Assessment conversations do not consume minutes.

Subscription minutes reset each billing cycle and do not roll over.

Deduction hierarchy:

  • 1st: One Way Ticket minutes (if active)
  • 2nd: Subscription minutes
  • 3rd: Pack minutes (Coffee Chat)
  • 4th: Flex minutes
  • 5th: PTO-redeemed minutes
7. One Way Ticket
Non-Refundable Commitment

The One Way Ticket is completely non-refundable under any circumstances. By purchasing, you acknowledge and accept this policy.

The One Way Ticket ($178.99) provides 1,500 conversation minutes over a 90-day period. Available to US users only. The countdown begins upon completion of La Promesa (voice commitment ceremony). No pauses, extensions, or transfers are available. Unused minutes expire at the end of the 90-day period.

Completing 85% of minutes (1,275 min) unlocks a prepaid Local subscription month. Failure to reach 85% forfeits this benefit.

8. Coffee Chat & Flex Minutes

Coffee Chats are one-time purchases of 30 conversation minutes at $3.99 (or MXN equivalent). Maximum 3 per account lifetime. Not available to users with active subscriptions. Minutes expire 90 days from purchase. Non-refundable.

Flex Minutes are available to active subscribers in bundles (10, 60, or 120 minutes) at rates based on subscription tier. Flex minutes never expire. Each purchase is a one-time transaction — not automatically billed. Non-refundable. No cash value. Cannot be transferred.

9. PTO (Practice Time Ownership)

PTO credits are earned automatically through regular conversation practice at rates determined by your plan tier (Free/Coffee 5%, Tourist 10%, Local 15%). PTO never expires. Credits can be redeemed in the PTO Store for learning rewards including Replay Analysis, Study Guides, Gift Codes, and Discounts. Monthly earning capped at 180 PTO; maximum balance capped at 500 PTO. PTO has no cash value and cannot be transferred between accounts.

10. Auto-Renewal & Cancellation
Auto-Renewal

Subscriptions automatically renew monthly unless cancelled. You authorize us to charge your payment method each month until you cancel.

  • Billing occurs monthly on your signup date
  • Cancel anytime through your account settings or by emailing hello@projectfluency.com
  • Cancellation takes effect at end of current billing period
  • Remaining minutes stay available until period ends
  • Price changes communicated 30 days in advance
11. Acceptable Use

You agree to use Project Fluency for personal language learning purposes. You may NOT:

  • Harass, abuse, or direct harmful language at AI characters or through the platform
  • Attempt to extract, reverse-engineer, or exploit the underlying AI models
  • Resell, sublicense, or redistribute access to your account
  • Use automated tools or bots to interact with the platform
  • Attempt to circumvent minute tracking, billing, or security systems
  • Create multiple accounts to bypass limits
12. Intellectual Property

Platform Content: All content, characters, character backstories, the Don Joaquín Universe, course materials, software, and branding are the property of Project Fluency Inc. and protected by intellectual property laws.

Your Conversations: Your conversation transcripts and personal learning data belong to you. We retain a license to use anonymized, aggregated data to improve our platform and services.

13. Service Availability & Liability

We strive for continuous availability but do not guarantee uninterrupted service. The Service is provided "AS IS" without warranties. We are not liable for downtime caused by third-party services (ElevenLabs, Stripe, Apple, Supabase), internet outages, or events beyond our control. If extended downtime affects your subscription, we may extend your billing period at our discretion.

Our liability is limited to the amount you paid for services in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.

14. Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or attempt to exploit the platform. You may terminate your account at any time through the account deletion option in your settings. Upon termination, your right to access the platform ceases, though we may retain certain data as required by law or for legitimate business purposes.

15. Governing Law & Contact

Governing Law: State of Delaware, United States.

Dispute Resolution: Any disputes shall be resolved through binding arbitration administered in accordance with applicable rules, except where prohibited by law. You retain your right to pursue claims in small claims court.

Privacy Policy

How we handle your data

1. Information We Collect

Information You Provide:

  • Account: Name, email address, age verification
  • Payment: Processed securely via Stripe or Apple (we never store card numbers)
  • Profile: Language levels, goals, preferences

Automatically Collected:

  • Conversation transcripts, learning progress, drilling performance
  • Character interaction history, device/browser information
  • Usage analytics and cookies
2. How We Use Your Data

Your data is used to:

  • Deliver and improve the learning experience across all 5 languages
  • Maintain character memory and adaptive question generation
  • Process billing and manage subscriptions
  • Communicate important account updates
  • Analyze platform performance and learning effectiveness
  • Develop new features
We do not sell your personal data to third parties.
3. Voice Data & AI Conversations
Voice Processing

During conversations, your voice is transmitted to ElevenLabs for real-time speech processing. Voice audio is processed transiently and is not stored by ElevenLabs after the conversation ends.

La Promesa Recordings: One Way Ticket commitment recordings are stored in our secure private cloud storage (signed URLs with expiration) and are accessible only to you. We do not use your voice data for AI model training.

Transcripts: Conversation transcripts are stored to enable character memory and adaptive learning. Transcripts are kept unless you request deletion.

4. Third-Party Services

We use the following third-party services to operate the platform:

  • ElevenLabs — Voice AI and conversation delivery
  • Anthropic Claude — AI analysis, content generation, and character memory
  • Stripe — Payment processing
  • Apple — In-app purchases (iOS)
  • Supabase — Database and infrastructure
  • Memberstack — Authentication

Each service has its own privacy policy. We share only the minimum data necessary for each service to function.

We NEVER sell your personal data to third parties.
5. Data Security

We use industry-standard security measures including encrypted connections (HTTPS/TLS), row-level security on database tables, signed URLs with expiration for sensitive content, and secure API key management. Payment information is handled entirely by Stripe and Apple — we never store credit card numbers on our servers. No security method is 100% secure, but we are committed to protecting your data.

6. Data Retention & Deletion

We retain your account data, conversation transcripts, and learning history for as long as your account is active. Cancelled accounts retain data for 12 months to facilitate potential return.

Account Deletion: Upon deletion request (via account settings), personal data is permanently removed within 30 days. This is irreversible. Anonymized, aggregated analytics data may be retained indefinitely.

7. Your Privacy Rights

You have the right to:

  • Access: Get a copy of your personal data
  • Correct: Update inaccurate information
  • Delete: Request deletion of your account and data
  • Export: Portability of your conversation history and progress data
  • Opt out: Of non-essential communications

8. Children's Privacy & Compliance

Project Fluency is intended for users aged 13 and older. We do not knowingly collect personal information from children under 13. If we learn that we have collected data from a child under 13, we will delete it promptly. Parents who believe their child has provided personal information should contact us at hello@projectfluency.com.

GDPR (EU): Right to erasure, portability, and complaints to data authorities. Data may transfer to US with safeguards.

CCPA (California): Know, delete, opt-out rights. We don't sell data.

9. Policy Updates & Contact

We may update this Privacy Policy to reflect changes in our practices or legal requirements. We will notify active users of significant changes via email at least 14 days before they take effect. The effective date at the top indicates the most recent revision.

Our Philosophy
We believe in fair, transparent billing.

We charge what it costs to deliver real AI conversations with characters who remember you — and we want you to feel confident that your money is well spent. If something isn't right, we'll make it right. Subscriptions have a refund window, one-time purchases don't, and commitment products are exactly that — commitments.

Monthly Subscriptions (Tourist & Local)
7-day refund window from purchase or renewal date.

Not satisfied within 7 days? Email hello@projectfluency.com for a full refund.

  • Refunds processed within 5–7 business days to original payment method
  • After the 7-day window, no partial or prorated refunds
  • If you cancel, you retain access to remaining minutes until end of billing period
Coffee Chats & Flex Minutes

Coffee Chats ($3.99) are non-refundable. As a low-cost, one-time purchase designed to let you experience the full platform before committing, all Coffee Chat sales are final.

Flex minute purchases are non-refundable. Flex minutes never expire and remain on your account as long as it is active.

One Way Tickets
Completely Non-Refundable

One Way Tickets ($178.99) are completely non-refundable under any circumstances. This is not a limitation — it is the product.

The One Way Ticket is a commitment device. The non-refundable nature creates accountability: you've made a promise (La Promesa), invested real money, and set a 90-day deadline. There are no exceptions, extensions, pauses, or partial refunds. If you are not prepared for this level of commitment, we encourage you to start with a monthly subscription instead.

Billing Disputes & Errors

If you believe you were charged incorrectly — duplicate charges, wrong amount, or charges after cancellation — contact us immediately at hello@projectfluency.com. Include your account email, the charge amount, and the date.

We will investigate within 24–72 hours and issue a full refund for any confirmed billing error, regardless of the 7-day refund window. For charges made through the Apple App Store, you may also contact Apple Support directly.
