The rules of engagement

1. Acceptance of Terms

By accessing or using Project Fluency™ ("the Service"), operated by Project Pilot Studios LLC, you agree to be bound by these Terms of Service. If you do not agree, please do not use our Service.

Age Requirement: You must be at least 13 years old. Users 13-17 must have parental consent.

2. Service Description

Project Fluency™ provides AI-powered language learning across 5 languages (Spanish, Italian, French, Portuguese, English) through conversational practice with 50+ unique AI characters.

AI Disclosure

Our AI characters are educational tools, NOT licensed teachers or certified experts. They may occasionally provide incorrect information. Always verify important language learning with additional resources.

Service includes:

Conversation practice with AI characters
Free assessment characters to test your level
Personalized learning insights and progress tracking
Character memory that remembers your journey

3. Beta Program

Beta Program Notice

You are participating in a beta program. The Service is provided "AS IS" without warranties. Features may change, be added, or removed. Service interruptions may occur.

4. Subscriptions & Pricing

Monthly Subscriptions (All 5 Languages):

Starter: $15/month — 100 minutes
Growth: $30/month — 240 minutes
Pro: $50/month — 425 minutes

Practice Packs: Pay-as-you-go at $0.20/minute. Expires 90 days from purchase. No memory or progress tracking.

Flex Minutes: Starter $0.17/min, Growth $0.14/min, Pro $0.12/min. Never expire.

5. Beta Discount Terms

Beta users receive 50% off for 24 months:

Discount starts from your beta enrollment date
Applies to any tier (Starter, Growth, Pro)
Upgrading/downgrading keeps discount until month 24
After 24 months, standard pricing applies
Ends if cancelled and not reactivated within 30 days

6. Auto-Renewal & Billing

Auto-Renewal

Subscriptions automatically renew monthly unless cancelled. You authorize us to charge your payment method each month until you cancel.

Billing occurs monthly on your signup date
Cancel anytime through your dashboard
Cancellation takes effect at end of billing period
Price changes communicated 30 days in advance

7. Minute Usage

Subscription Minutes: Reset monthly. Do not roll over. Used first.

Practice Pack Minutes: Expire 90 days from purchase. Used after subscription minutes.

Flex Minutes: Never expire. Used last. Only for subscribers.

8. Voice Recording & Data

By using conversation features, you consent to:

Recording of your voice during AI conversations
Transcription and storage of conversation content
Analysis of conversations for learning insights
Use of anonymized data to improve the platform

9. User Accounts & Security

You are responsible for:

Providing accurate information
Maintaining password security
Not sharing your account
Notifying us of unauthorized use
All activities under your account

10. Acceptable Use

You agree NOT to:

Use the Service for illegal purposes
Manipulate or abuse AI characters
Share account credentials
Reverse engineer our technology
Create multiple accounts to bypass limits
Use bots or automated systems
Interfere with the Service

11. Intellectual Property

Platform Content: All content is owned by Project Pilot Studios LLC and protected by intellectual property laws.

Your Conversations: You retain ownership of your speech. You grant us license to use anonymized data for platform improvement.

12. Limitation of Liability

The Service is provided "AS IS" without warranties. We do not guarantee uninterrupted service, accuracy of AI responses, or specific learning outcomes.

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, or consequential damages.

13. Dispute Resolution

Governing Law: State of Wyoming, USA.

Informal Resolution: Contact hello@projectfluency.com first.

Arbitration: Binding arbitration via American Arbitration Association rules.

14. Changes & Contact

We may update these Terms. Changes posted with new "Last Updated" date. Material changes communicated via email.

How we protect your data

Project Pilot Studios LLC operates Project Fluency™. This Privacy Policy explains how we collect, use, disclose, and safeguard your information.

Your privacy matters to us.

We are committed to transparency and giving you control over your information.

2. Information We Collect

Information You Provide:

Account: Name, email, password, age verification
Payment: Processed via Stripe (we don't store card numbers)
Profile: Language levels, goals, preferences
Voice: Recordings during AI conversations

Automatically Collected:

Usage data, learning analytics, device info, cookies

3. Voice Data & AI Conversations

Voice Recording

Your voice is recorded and processed by third-party AI providers. This includes transcription, storage, and analysis for learning insights.

Retention: Raw audio deleted after transcription. Transcripts kept unless you request deletion.

4. How We Use Your Information

Provide the Service across all 5 languages
Process payments and manage subscriptions
Personalize your learning experience
Enable character memory
Generate learning insights
Send service updates and billing notifications
Detect and prevent fraud

5. Data Sharing & Third Parties

We share with:

Service Providers: AI providers, Stripe, Supabase
Legal: When required by law
Business Transfers: In merger/acquisition

We NEVER sell your personal data to third parties.

6. Data Retention & Deletion

Account Deletion: Upon request, we delete your data within 24 hours. This is permanent and cannot be reversed.

Inactive Accounts: Accounts inactive 2+ years may be deleted after notification.

7. Your Privacy Rights

You can:

Access: Get a copy of your data
Correct: Update inaccurate info
Delete: Request deletion (24-hour)
Export: Portability of your data
Object: Opt-out of processing

8. GDPR, CCPA & COPPA

GDPR (EU): Right to erasure, portability, and complaints to data authorities. Data may transfer to US with safeguards.

CCPA (California): Know, delete, opt-out rights. We don't sell data.

COPPA: Service for 13+. Users 13-17 need parental consent. We don't knowingly collect from under-13.

9. Security & Contact

We use encryption, audits, limited access, and multi-factor auth. No method is 100% secure.

Practice Packs

7-Day Guarantee: Refund within 7 days if under 15 minutes used.

Refund = Total - (Minutes used × $0.20)
One refund per 12-month period

After 7 days or 15+ minutes: No refunds. Minutes expire 90 days from purchase.

After 14-Day Guarantee

Cancel anytime before next billing date
No refunds for partial months
Unused minutes don't roll over
Flex minutes are non-refundable
Service continues until end of period

Technical Issues & Beta

Technical Issues: Report within 48 hours. Extended outages (24+ hours) may qualify for credits.

Beta Limitations

Beta interruptions and feature changes may not qualify for refunds.
